Over the past few years, our trial successes include multiple jury verdicts exceeding two million dollars against IVC filter manufacturers, including a record $3 million dollar verdict in a bellwether IVC filter case filed in the Cook Medical MDL in Indianapolis. This verdict, which at the time was largest actual damages award ever in any IVC filter case, was tried by a team of lawyers led by Ben C. Martin and Laura J. Baughman. The jury in Brand v. Cook Medical Inc. and William Cook Europe, found, for the first time, that a medical device company had defectively designed an IVC filter.'

Since then, our trial lawyers have won four jury trials against C. R. Bard, Inc. and Bard Peripheral Vascular, Inc. (“Bard”), including a $3.3 million actual damages verdict that broke the previous record, also held by Martin Baughman lawyers, of the largest such award nationwide in an IVC filter case.

Martin Baughman’s trial successes are not limited to IVC filters; they include a wrongful death case tried in Dallas, Texas against a multi-billion dollar railroad company. In Rigsby v. Kansas City Southern Railway, a Dallas, Texas jury found the railroad responsible for the tragic death of a driver at a dangerous railroad crossing.

Ben is also on the Plaintiffs’ Steering Committee in the Cordis IVC filter litigation and is co-lead counsel in coordinated litigation pending in Philadelphia against Rex Medical regarding its Option IVC filter. Laura Baughman serves on the Cordis IVC filter steering committee and is an integral part of trial teams in IVC filter and transvaginal mesh cases in federal and state courts across the country.
