We regularly represent corporations and individual clients in inquiries and investigations by federal authorities, the US Department of Justice, state attorneys general, and local prosecutors, and in all stages of white collar criminal and regulatory litigation in federal, state, and local courts. We litigate cases at all levels of the federal and state courts, in arbitration, and before government agencies, regulatory organizations, and other tribunals.
We have persuaded the government not to indict identified grand jury targets, thereby helping individuals and corporations avoid criminal charges altogether. Where there is an indictment, because of our experience, reputation, and thorough work, we often are able to obtain favorable pretrial dispositions. Similarly, in civil disputes, our ability and willingness to try high-stakes cases often helps us achieve advantageous settlements without trial. Our lawyers also provide litigation-avoidance advice and other confidential legal counseling, often in highly sensitive contexts.
Institutional clients frequently retain us to conduct sensitive internal investigations aimed at uncovering or resolving allegations of officer, director, trustee, or employee misconduct, both in the US and globally. Our lawyers are regularly selected to lead court-appointed independent monitorships, and have been appointed to government-approved positions as corporate integrity counsel in many matters. Over the past several years, we have been at the forefront of every major white collar issue, including investigations and litigation relating to insider trading, Foreign Corrupt Practices Act (FCPA) enforcement, revenue recognition and accounting restatements, the Madoff scandal, LIBOR manipulation, the sale of CDOs and other structured products impacted by the global financial crisis, commodities-related trading, auction rate securities, foreign currency exchange, tax shelters, unreported foreign banking activity, stock option backdating, and alleged abuses by market participants at the New York Stock Exchange and other national exchanges. Our cases frequently focus on economic crime, as well as complex matters concerning allegations of environmental offenses; customs, insurance, and health care fraud; violations of the False Claims Act and federal and state antitrust laws; and theft of intellectual property, bribery, and political corruption. We are well-known for our appellate practice and regularly handle complex, civil and criminal appeals before federal and state courts throughout the nation. We are frequently retained to work on appeals for clients who were represented in the lower courts by other law firms.
